Bombay HC to Lawyers Requesting Local Train Access: ‘We Can’t Go Beyond Medical Advice’

A group of lawyers filed public interest litigations (PILs) with the Bombay High Court (HC) requesting access to local trains. Hearing these petitions, a bench of Chief Justice Dipankar Datta and Justice G S Kulkarni said that although they empathize with the troubles faced by lawyers in Mumbai, they cannot go against medical advice. 

Subsequently, the bench has asked the Maharashtra Government to inform the court by July 16 if 60 registered judicial clerks of the High Court can be permitted to use trains as the HC was only permitting the physical filing of cases.

After informing the state counsel, Poornima Kantharia to let the court know about the government’s decision, the lawyer for the petitioners, Advocate Shyam Devani mentioned that lawyers were also suffering due to their inability to travel via local trains. 

In response, the bench said, “Don't think we are not concerned about lawyers' problems. But we can't go beyond medical advice. We are taking advice from the highest expert body in the state, the Maharashtra COVID-19 task force.” The next hearing on the matter will be held on the 16th of July. 

As of now, local trains are only available to essential and frontline workers. Some relaxations have been sought by other sectors due to the increase in fuel prices over the past few weeks.
