SC allows 13-year-old rape survivor to abort 32-week-old fetus

On Wednesday, the Supreme Court allowed a 13-year-old rape survivor from Mumbai to abort a 32-week-old fetus. The operation will be carried out on Friday at J J Hospital as SC gave the order after a panel of doctors said that the pregnancy posed a risk to the girl’s life. According to doctors, the baby will be born preterm and will have its own complications.


At first, the girl’s mother took her to a local doctor as she had put on a lot of weight. There they learned about her pregnancy. She was 29 weeks pregnant already. On August 23, they moved to the court. 

To terminate pregnancy, a woman should be more than 20 weeks pregnant. In last few months, the SC has allowed many rape victims to terminate their pregnancy and it is a good thing. Now, the government should make amendments in the law and should allow termination post 24 weeks pregnancy, Dr Nikhil Datar, petitioner.

This is not the first case when a rape victim sought permission for an abortion from the SC. However, in many cases, the SC refused the pleas stating that in many cases, the pregnancy was too advanced to carry out the procedure. The court did not allow a 10-year-old rape survivor from Chandigarh to abort a 32-week fetus.
