Maharashtra Cabinet again asks Governor Bhagat Singh Koshyari to nominate Uddhav Thackeray as an MLC

The deadline for Maharashtra Chief Minister Uddhav Thackeray to get elected to the state legislature is May 27. The cabinet has yet again asked the Governor to nominate Uddhav Thackeray to the legislative council.

The state cabinet on Monday once again asked Maharashtra Governor Bhagat Singh Koshyari to nominate Chief Minister Uddhav Thackeray as an MLC from the governor’s quota. 

Earlier, in a meeting chaired by Maharashtra Deputy Chief Minister Ajit Pawar, the state cabinet had recommended Uddhav Thackeray’s name to the Governor who has two vacant seats from his quota. The cabinet had recommended Thackeray’s name to one of the two seats to avoid a constitutional crisis. 

Uddhav Thackeray took oath as Maharashtra Chief Minister on November 28, 2019, and is not the member of either house - legislative assembly or council. According to the Indian constitution, within six months of taking the oath, any minister is supposed to get elected in either state legislative assembly or council. 

The deadline for Maharashtra Chief Minister Uddhav Thackeray to get elected to the state legislature is May 27. The cabinet has yet again asked the Governor to nominate Uddhav Thackeray to the legislative council. This meeting was also chaired by Ajit Pawar. 

If the Governor fails to act on the recommendations made by the state cabinet, Chief Minister Uddhav Thackeray will have to resign and take the oath again. However, according to article 163 (3) of the Indian constitution, the Governor has to act on the recommendations made by the council of ministers. 

Amid the pending approval of Maharashtra Governor to nominate Chief Minister Uddhav Thackeray as an MLC, Shiv Sena leader Sanjay Raut had questioned Governor Koshyari over the delay and said, “who was stopping him to nominate Uddhav Thackeray as an MLC?”

Sanjay Raut, in his weekly column ‘Rokhtok’ published in ‘Saamana’, attacked the opposition party and said that they should realise that the Shiv Sena-led government will remain in power under Uddhav Thackeray even after May 27. 

Furthermore, Raut stated that the image of Governor Bhagat Singh’s image is getting maligned because BJP leaders are frequently meeting him at Raj Bhavan as if he was still a leader of the saffron party.

On various occasions, the senior leaders of BJP including LoP Devendra Fadnavis and Kirit Somaiya have met Governor Koshyari. The BJP has even submitted memorandums pointing out faults over various issues under the Maharashtra Vikas Aghadi (MVA) government.
