After Nationalist Congress Party (NCP) Minister Nawab Malik announced that there will be a 5 per cent reservation for Muslims in the education sector, Shiv Sena on Sunday denied any such proposal saying that there has been no discussion on the matter. 

Senior Shiv Sena leader and Maharashtra Urban Development Minister, Eknath Shinde also stated that no decision has been taken on this issue yet while adding that the MVA government works as per the Common Minimum Programme (CMP). 

While talking to the reporters, Shinde said that leaders of the Maha Vikas Aghadi (MVA) government will together take a call on policy decisions about providing reservation to any community and Chief Minister Uddhav Thackeray will take appropriate decision at an appropriate time. 

Another Sena leader and Maharashtra Transport leader, Anil Parab informed that the MVA government will discuss the issue to provide 5 per cent reservation for Muslims in educational institutions and will seek legal opinion on the same before making a decision. 

However, Congress and NCP have claimed that the reservation for Muslims was part of the CMP and was discussed before the government formation. The common minimum programme has been formulated by the three ruling parties including Congress, NCP and Shiv Sena for the smooth functioning of the government. 

Earlier, Leader of Opposition (LoP) in Maharashtra legislative assembly and senior BJP leader, Devendra Fadnavis said that Muslim quota will be unconstitutional and will affect the OBC and Maratha reservations. 

While speaking to the media outside the Maharashtra legislative assembly, Fadnavis stated that the constitution had no provision for reservation based on religion. 

Reacting to this, OBC leader Prakash Shendge said that the Muslims quota will not affect either Maratha or OBC reservation but will come out of the general category. 

On February 28, Maharashtra Minority Affairs Minister announced that the MVA government will provide 5 per cent reservation for Muslims in all the educational institution in the state. 

Nawab Malik informed that legislation to this effect will be passed soon in the Maharashtra legislative. While speaking in the upper house, Malik assured of taking “appropriate action” in this regard.

Earlier in 2014, the Congress and NCP government in Maharashtra had issued an ordinance providing 5 per cent reservation to Muslims along with 16 per quota for the Maratha community. However, the Devendra Fadnavis government failed to enact a law for the Muslims quota and went ahead with legislation for Maratha reservation in education and jobs.
