CM should repeal the law which backs corrupt politicians: Nawab Malik

On October 23, 2017, Rajasthan government tabled a bill to change its ordinance which protects serving and former judges, magistrates and public servants from prosecution without prior sanction. This ordinance, 2017 did not go down well with the Congress and Aam Aadmi Party (AAP) who criticised the ordinance.

Meanwhile, Nationalist Congress Party (NCP) leader Nawab Malik mentioned that a similar legislation was implemented in Maharashtra on August 30, 2016, and he wants Maharashtra CM Devendra Fadnavis to repeal it.


This act has been brought in to shield corrupt politicians and government officials. Our CM believes in transparency and he should immediately repeal the law in Maharashtra,” Nawab Malik, NCP Spokesperson.

Section 2 of the Act inserts the following provision in the CrPC— "Provided that no Magistrate shall order an investigation under this section against a person who is or was a public servant as defined under any law for the time being in force, in respect of the act done by such public servant while acting or purporting to act in the discharge of his official duties, except with the previous sanction under section 197 of the Code of Criminal Procedure, 1973 or under any law for the time being in force."
