On Monday, December 6, the Supreme Court stayed the 27 per cent reservation for the Other Backward Classes (OBC) in the local body elections until further orders, stated reports.

The bench comprised Justices AM Khanwilkar and CT Ravikumar passed the order in writ petitions that were filed challenging the Maharashtra Ordinance that introduced a 27 per cent OBC quota in the local body elections.

Similarly, the following notifications proclaimed by the State Election Commission gave effect to the same. It was observed by the bench that the 27 per cent quota cannot be initiated without putting up a commission or collecting statistics about the inadequacy of the representation local governmentally.

According to accounts, the bench ordered that the State Election Commission can’t be allowed to go ahead with the election procedure that has already been notified in regards to the OBC reservation category.

However, based on reports, it ordered that the remaining of the election program can go ahead for other reserved seats that comprised the general category. The bench ordered that the SEC shall not notify the reserved seats in the category of OBC.

This will be applicable for the midterm or various general elections as the case is until further orders. If narratives are to be believed, tomorrow is the last day to file nominations for the local body.

On Wednesday, the state government undertook the decision to bring in an ordinance to give OBC quota in the arriving by-elections to a certain number of local governing bodies without waving the apex court rule of 50 per cent limit on the reservation.

The court stated that the state brought in the ordinance without adhering to the triple tests.
